Please read this End User License Agreement ("Agreement", "Terms of Use") carefully before downloading, installing, or using the iRemote - TV Remote & Mirroring application ("Application", "App") operated by TechSmart LLC ("us", "we", or "our").
By downloading, installing, or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download or use the Application.
You and TechSmart LLC acknowledge that this Agreement is concluded between you and TechSmart LLC only, and not with Apple Inc. ("Apple"). TechSmart LLC, not Apple, is solely responsible for the Application and the content thereof. The Application is licensed, not sold, to you for use only under the terms of this Agreement. TechSmart LLC reserves all rights not expressly granted to you.
TechSmart LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with the terms of this Agreement on any Apple-branded products (such as iPhone, iPad, or iPod touch) that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
The Application may offer premium features, which can be accessed through one-time in-app purchases or auto-renewing subscriptions.
The Application is designed to communicate with third-party Smart TVs and devices (e.g., Samsung, LG, Roku, Fire TV). You acknowledge that TechSmart LLC is completely independent and is not affiliated with, endorsed by, or sponsored by any of these third-party manufacturers. We do not guarantee permanent compatibility, as third-party firmware updates may alter or break the Application's ability to control specific TV models.
TechSmart LLC is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this Agreement, or as required under applicable law. You and TechSmart LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
The Application is provided to you "AS IS" and "AS AVAILABLE" without warranty of any kind. TechSmart LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
You and TechSmart LLC acknowledge that TechSmart LLC, not Apple, is responsible for addressing any claims of you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You and TechSmart LLC acknowledge that, in the event of any third-party claim that the Application or your possession and use of that Application infringes that third party’s intellectual property rights, TechSmart LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the Application. For example, you must ensure that your use of the Application does not violate your wireless data service agreement or your internet service provider's terms.
To the maximum extent permitted by applicable law, in no event shall TechSmart LLC, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Application.
You and TechSmart LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Application after any revisions become effective, you agree to be bound by the revised terms.
